Divorce by mutual consent is under Section 13-B of the Hindu Marriage Act, 1955.
Eligibility
Both parties must agree and must have lived separately for at least one year.
First Motion
A joint petition is filed before the Family Court.
Cooling-Off Period
A mandatory 6-month period follows. The court may waive this in exceptional circumstances.
Second Motion and Decree
After 6 months the court passes the decree of divorce.
